Transient rent: what is it

Transitional renting is a limited-term lease formula, usually between 1 and 18 months, designed to meet the temporary needs of those seeking housing, such as off-site students or workers on the move.

This formula offers considerable flexibility and allows for an ad hoc contract for the required length of stay.

Transient rent, rent by agreement or rent free? Differences

Transitional rent differs from rent by agreement and rent free in terms of duration and contract terms.

While rent by agreement provides for longer durations (3+2 or 4+4 years) and rents set according to tables agreed upon between the municipality and trade associations, free rent has no duration limits and the rent is freely negotiable between landlord and tenant.

Advantages and disadvantages of transient renting: pros and cons

Transitional renting offers advantages for both landlords and tenants, including flexibility, ease of stipulation, and the ability to tailor the contract to specific temporary needs. However, it may have disadvantages such as slightly higher costs than other types of leases and fewer protections for tenants and landlords in case of disputes.

Transient rent vs. other types of rent: costs and benefits

Althoughtransient rent ing may have slightly higher costs than other types of renting, it offers more flexibility and better meets temporary needs. Therefore, it is important to weigh the costs and benefits of transitional renting against other solutions, taking into account one’s needs and priorities.

Some concrete examples include:

  • Rent
    :
Transient rent may have a slightly higher monthly rent than rent by agreement or rent free. However, the flexibility offered by the transitional rental can make up for the difference in cost. For example, a transitional rental might cost 800 euros per month, while an agreed rent in the same area might cost 700 euros per month. If a tenant plans to stay only for 6 months, transitional rent could be more affordable despite the higher rent, avoiding duration constraints typical of other types of rent.

  • Registration fees and taxes
    :
Transient rent is subject to the same registration and stamp taxes as other types of rent. But the limited duration of the contract may result in lower overall expenses over time. For example, a 6-month transitional lease will have lower registration costs than a 3-year fixed-rate lease.

  • Early termination of the contract: Transitional tenancy offers more flexibility in contract termination, with shorter notices than other types of tenancy. This can be advantageous for a tenant who needs to change housing quickly, avoiding additional costs or penalties associated with early termination of the contract.

  • Certainty of durability: transient rental offers a predetermined duration and agreed upon between landlord and tenant, providing greater certainty for both the renter and the tenant. In a rent free, for example, the landlord might decide to sell the property or not renew the contract, forcing the tenant to look for a new place to live quickly.

Operation of the transient rental agreement

– Duration and terms of the contract

The duration of the transitory lease contract usually varies between 1 and 18 months , according to the needs of the parties. At the end of the stipulated term, the contract may be renewed or terminate automatically.

– Renewal, cancellation and withdrawal

Renewal of the contract may be by mutual agreement between landlord and tenant. Cancellation and termination, on the other hand, must be given in writing with a notice period stipulated in the contract (e.g., 30 or 60 days).

– Security Deposit

The security deposit, usually 1-3 months ‘ rent, is used to guarantee the landlord in case of tenant default. At the end of the contract, the deposit must be returned to the tenant, subject to any deductions for damage to the property or overdue (or missing) payments.

Registration of transient rental agreement: legal aspects and costs

registration transitional rental contract revenue agency

The transitional lease agreement must be registered with the Internal Revenue Service within 30 days of signing. Registration entails the payment of registration taxes-unless you opt for the dry coupon tax-and any penalties for delays.

To register the contract, it is necessary to fill in the RLI form (Richiesta di Lease Immobiliare) and attach a copy of the rental contract. The RLI form can be completed and submitted online through the RLI Web service, or in hard copy at the offices of the Internal Revenue Service.

The costs of registering a transitional rental agreement consist of the registration tax and any penalties for late registration. The registration tax is 2 percent of the annual rent, with a minimum amount of 67 euros.

For example, if the monthly rent is €800, the registration tax will be calculated as follows: €800 × 12 months = €9,600 annually, 2% of €9,600 = €192 registration tax.

In case of late registration of the contract, there are penalties of 120% of the registration tax due, with a minimum amount of €150.

For example, if the registration tax is €192, as in the example above, the penalty for late registration will be calculated as follows: €192 x 120% = €230.40 penalty.

It is important to note that, in addition to the registration tax, landlord and tenant must also paystamp duty on the rental contract, which is 16 euros for every 4 pages of contract or every 100 lines of text.

The registration of the transitional rental contract must be renewed annually, until the expiration of the contract, by submitting an updated RLI form and paying the relevant taxes. If the contract is renewed or conditions change, such as an increase in rent, it will be necessary to submit a new RLI form with updated data and pay the relevant taxes and stamps.

Taxation and tax deductions of transient rental agreement

The landlord is subject to income tax(IRPEF) for income from transient renting. However, there are tax deductions for renovation and maintenance expenses of the property. The tenant is eligible for tax deductions for rental expenses, provided he or she meets the requirements of the law.

See this page on tax breaks for more information.

Responsibilities of landlord and tenant

The landlord has the obligation to hand over the property in good condition and ensure its extraordinary maintenance, while the tenant must take care of routine maintenance and payment of rent. Both parties must abide by the terms of the contract and current regulations on transient rentals.
